2. Description of Service

Kixar Platform: We operate a digital marketplace that connects users seeking sports facilities with turf owners and facility providers. We facilitate bookings and handle payments but do not own or operate the sports facilities.

2.1 For Users (Bookers)

  • Browse and search sports facilities
  • Make bookings and payments through our platform
  • Receive booking confirmations and manage reservations
  • Access customer support for booking-related issues

2.2 For Turf Owners

  • List sports facilities on our platform
  • Manage availability, pricing, and facility policies
  • Receive bookings and periodic settlement payments
  • Set refund and cancellation policies for their facilities

3. Business Model and Payments

3.1 Payment Processing

Payment Gateway: All payments are processed securely through Razorpay, our authorized payment partner. Users pay directly to Kixar, and we handle settlements with turf owners.

3.2 Settlement Model

How Payments Work:

  1. User Payment: Users pay the full booking amount to Kixar through Razorpay
  2. Booking Confirmation: We confirm the booking with the turf owner
  3. Service Completion: Users utilize the booked sports facility
  4. Periodic Settlement: We transfer the turf owner's share periodically (weekly/monthly) after deducting our commission

3.3 Commission and Fees

  • Platform Commission: Kixar retains a percentage of each booking as our service fee
  • Payment Processing: Razorpay fees are as per their current rates and may be passed to users or deducted from settlements
  • Transparent Pricing: All fees and commissions are disclosed during the booking process

3.4 Settlement Schedule

Turf Owner Payments: We settle payments to turf owners on a periodic basis (typically weekly or bi-weekly) for completed bookings, subject to our verification and quality processes.

4. Booking and Cancellation Policies

4.1 Booking Confirmation

Bookings are confirmed only after successful payment and verification by the turf owner. We reserve the right to cancel bookings if facilities become unavailable due to unforeseen circumstances.

4.2 Cancellation and Refund Policy

Important: Refund Policy

  • Individual Turf Policies: Each turf owner sets their own cancellation and refund policy
  • Non-Refundable Bookings: If a turf owner's policy states "non-refundable," no refunds will be processed once the booking is confirmed
  • Policy Display: Cancellation policies are clearly displayed during the booking process
  • Platform Discretion: Kixar may approve refunds in exceptional circumstances (facility closure, natural disasters, etc.)

4.3 Modification Requests

Booking modifications (date, time, duration) are subject to availability and the turf owner's modification policy. Additional charges may apply for modifications.

5. User Responsibilities

5.1 For All Users

  • Account Security: Maintain confidentiality of account credentials
  • Accurate Information: Provide truthful and current information
  • Compliance: Follow all applicable laws and regulations
  • Respectful Conduct: Treat other users and facilities with respect
  • Age Requirement: Must be 18 years or older to use our services

5.2 For Bookers

  • Timely Arrival: Arrive on time for bookings or forfeit the reservation
  • Facility Care: Use facilities responsibly and report any damages
  • Payment: Ensure sufficient funds and valid payment methods
  • Policy Acceptance: Accept individual turf cancellation policies before booking

5.3 For Turf Owners

  • Facility Maintenance: Maintain facilities in good, safe condition
  • Accurate Listings: Provide accurate facility descriptions and amenities
  • Availability Management: Keep availability calendars updated
  • Service Standards: Meet promised service levels and quality
  • Legal Compliance: Maintain all required licenses and permits
  • Clear Policies: Set and communicate clear cancellation/refund policies

6. Platform Rules and Conduct

6.1 Prohibited Activities

  • Fraudulent Activities: False bookings, payment fraud, or identity misrepresentation
  • Platform Misuse: Circumventing our booking system or payment processes
  • Spam or Harassment: Unwanted communications or abusive behavior
  • Illegal Activities: Using facilities for illegal purposes
  • Review Manipulation: Fake reviews or ratings manipulation
  • Direct Contact Circumvention: Attempting to book directly to avoid platform fees

6.2 Account Suspension

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activities, or compromise platform integrity.

7. Dispute Resolution

7.1 Customer Support

For all disputes, concerns, or issues, please contact our customer support team first. We are committed to resolving issues fairly and promptly.

7.2 Refund Disputes

Refund Process:

  1. Review Policy: We first check the applicable turf owner's refund policy
  2. Documentation: Gather relevant booking and cancellation details
  3. Mediation: Facilitate discussion between user and turf owner if applicable
  4. Final Decision: Make a decision based on policies, circumstances, and platform terms
  5. Processing: If approved, refunds are processed through the original payment method within 5-7 business days

7.3 Legal Disputes

Any legal disputes will be resolved through arbitration in accordance with the laws of [Your Jurisdiction]. Users agree to binding arbitration and waive rights to class action lawsuits.

8. Liability and Insurance

8.1 Platform Liability

Marketplace Model: Kixar Pvt Limited operates as an intermediary platform. We are not liable for the quality, safety, or condition of sports facilities, or for any injuries or damages that may occur during facility use.

8.2 Limitation of Liability

  • Service Interruptions: Not liable for temporary platform downtime or technical issues
  • Third-Party Actions: Not responsible for turf owner actions or facility conditions
  • Maximum Liability: Our maximum liability is limited to the amount paid for the specific booking in question
  • Consequential Damages: Not liable for indirect, incidental, or consequential damages

8.3 User Insurance

Users are strongly encouraged to maintain appropriate personal insurance coverage for sports activities. Turf owners are responsible for maintaining liability insurance for their facilities.

9. Intellectual Property

9.1 Platform Content

All content on the Kixar platform, including design, logos, text, graphics, and software, is owned by Kixar Pvt Limited or our licensors and is protected by intellectual property laws.

9.2 User Content

By uploading content (reviews, photos, etc.), you grant Kixar Pvt Limited a worldwide, royalty-free license to use, display, and distribute such content for platform operations and marketing.

9.3 Trademark

"Kixar" and our logo are trademarks. Users may not use our trademarks without prior written consent.

10. Data Protection and Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

Payment Security: All payment processing is handled by Razorpay using industry-standard security measures. We do not store complete payment card information on our servers.

11. Platform Modifications

11.1 Service Changes

We reserve the right to modify, suspend, or discontinue any part of our service at any time. We will provide reasonable notice for significant changes that affect existing bookings.

11.2 Terms Updates

These Terms may be updated periodically. We will notify users of material changes via email or platform notifications. Continued use constitutes acceptance of updated Terms.

12. Force Majeure

Neither Kixar Pvt Limited nor turf owners are liable for failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, government actions, pandemics, or other force majeure events. In such cases, affected bookings may be cancelled with appropriate refund consideration.

13. Governing Law
